Guidelines for receiving foreign non-governmental aid

Application for aid

a) The aid recipient and the aid holder shall coordinate with the aid supplier in developing application program, technical assistance project; program documents, projects of investment and using aid; application for the aid according to the Article 8 of Decree No. 80/2020/ND-CP. Sample structure of program documents and projects according to the form in Appendix 1, 2, 3 issued together with Decree No. 80/2020/ND-CP.

b) In case the aid project needs to use reciprocal capital being public investment capital: The application includes the compositions as prescribed in Article 8 of Decree No. 80/2020/ND-CP and the composition of the application according to the Law on Public Investment, Decree No. 40/2020/ND-CP dated April 6, 2020 of the Government detailing the implementation of a number of articles of the Law on Public Investment and relevant guiding documents.

c) In case the aid project has a construction component: The application includes component as prescribed in Article 8 of Decree No. 80/2020/ND-CP and the application component as prescribed by the Construction Law and related instruction documents.

d) The Department of Planning and Investment shall and coordinate with the Department of Foreign Affairs and relevant agencies in guiding the aid recipient to prepare an application for the aid amount and submit it for appraisal and approval according to regulations.

 

Appraisal of aid

a) The Department of Planning and Investment is the agency that receives the application and assumes the prime responsibility for the appraisal of the aid amount approved by the Chairman of the Provincial People's Committee. For other aids that are not under the approval competence of the Chairman of the Provincial People's Committee, the Department of Planning and Investment shall coordinate with relevant agencies to advise the Provincial People's Committee to comment at the request of the head of the governing body.

b) Order and procedure for appraisal as prescribed in Article 10 of Decree No. 80/2020/ND-CP.

 

Aid approval

The Chairman of the Provincial People's Committee approves the aid on the basis of the appraisal report of the Department of Planning and Investment. The content of the approval decision is in accordance with Article 11 of Decree No. 80/2020/ND-CP.

 

Aid mobilization

Department of Foreign Affairs is the agency to mobilize NGO aid and assist the aid recipient and the aid holder in negotiation and signing with the aid supplier on program documents on technical assistance project; program documents on aid investment and using projects.
